Police chief sued over woman's death

THE Attorney General (AG) has objected to a suit filed against Police chief Maj. Gen. Kale Kayihura over the death of a woman in Kasubi last September.

Abdalla Byabasaija filed a suit in the Kampala High Court early this year seeking damages from both Kayihura and the Government for the death of his wife, Stella kabasinguzi. She was reportedly was gunned down at the verandah of her house during riots that happened in September.

Appearing before Justice Vincent Zehurikize on Wednesday, Elison Karuhanga the AG’s representative objected to the inclusion of Kayihura. “The first respondent cannot be liable to the actions of the Police force,” he said.

Byabasaija’s lawyer, Ladislaus Rwakafuuzi, argued that Kayihura was sued because he was in direct command of the forces that killed the deceased.

Rwakafuuzi asked the judge to compel Kayihura to appear in court and explain what happened during the riots. However, Zehurikize, said it is premature to ask him to do that because the hearing is still at the preliminary stage.
