Bring all witnesses in Kajubi case - Judge

THE Masaka High Court judge has urged the prosecution in the ritual murder case against city tycoon Godfrey Kajubi to assemble all its witnesses by March 29. Justice Moses Mukiibi said the move would enable the court to expedite the trial.

“We are in extra time. It is crucial for the prosecution to get all the witnesses so that the case is heard without any more delays,” the judge said.

Mukiibi’s request followed an application for an adjournment of the case by a senior state attorney. Vincent Wagona said the adjournment would enable the prosecution recall the former Masaka CID chief, Christopher Rugumayo, and four others to clarify on issues which were unclear before the court adjourned last year. Rugumayo was transferred to Mbarara.

Wagona said although the witnesses he wanted to recall had testified in the case, the prosecution found it crucial that they should clarify on important points concerning their evidence.
The judge set three consecutive days, March 29, 30 and 31, within which the prosecution would be expected to produce its remaining witnesses so that the case could be concluded.

Earlier, Justice Mukiibi quizzed the Masaka district deputy CID chief, Stephen Etyang, accusing him of conniving with a Police officer to doctor a document that was changing the reference number of the case.
“Do you want to be told that you cooked that correction because there was a problem with this case?” Mukiibi asked Etyang.

However, Etyang denied doctoring any document concerning the case.
Kajubi was indicted for the murder of 12-year-old Joseph Kasirye in a suspected ritualistic act on October 27, 2008 at Kayugi village, Masaka district.

He had been indicted together with a traditional doctor, Umaru Kateregga, and his wife, Mariam Nabukeera, who were later turned state witnesses in the case.
